Welcome to Voquill. These Terms of Service ("Terms") govern your use of the Voquill open source software application ("Software"). By downloading, installing, or using the Software, you agree to be bound by these Terms.

1. Open Source License

Voquill is open source software. The Software's source code is available under the terms of its open source license (as specified in the repository). These Terms supplement, but do not replace, the applicable open source license.

2. No Account Required

Voquill does not require account registration. You can download and use the Software freely without providing any personal information.

3. Local Installation & Use

The Software runs locally on your device. You are responsible for:

  • Ensuring your device meets the Software's system requirements
  • Maintaining the security of your local installation
  • Managing any data you create or store using the Software
  • Backing up your local data as needed

4. Third-Party Services

4.1 Optional Groq API

If you choose to use the Groq API integration:

  • You are responsible for obtaining your own Groq API credentials
  • Your use of Groq services is subject to Groq's terms of service and privacy policy
  • We are not responsible for Groq's service availability, performance, or practices
  • API keys and credentials are stored locally on your device

4.2 Your Responsibility

You are solely responsible for your use of any third-party services integrated with the Software.

5. Acceptable Use

You agree to use the Software:

  • In compliance with all applicable laws and regulations
  • In a manner that respects the rights of others
  • Without attempting to misuse, exploit, or reverse engineer the Software for malicious purposes

6. Intellectual Property

6.1 Open Source Software

The Software is provided under an open source license. You have the rights granted by that license, including the right to use, modify, and distribute the Software as permitted.

6.2 Trademarks

The "Voquill" name and associated trademarks remain the property of their respective owners. Use of the Software does not grant you rights to use these trademarks except as permitted by the open source license.

6.3 Your Content

You retain all rights to any audio, transcriptions, or other content you create using the Software. The Software does not claim any ownership of your content.

7. Contributions

If you contribute code, documentation, or other materials to the Voquill project, you agree that your contributions will be licensed under the same open source license as the Software.

8. Disclaimers

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

  • The Software will be error-free or uninterrupted
  • Defects will be corrected
  • The Software is free from viruses or other harmful components
  • Results obtained from using the Software will be accurate or reliable

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE VOQUILL DEVELOPERS AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY:

  • Direct, indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or other intangible losses
  • Damages resulting from your use or inability to use the Software
  • Damages resulting from unauthorized access to your data
  • Damages resulting from third-party services (including Groq API)

10. Indemnification

You agree to indemnify and hold harmless the Voquill developers and contributors from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of the Software
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your use of third-party services

11. No Service Level Agreement

Since the Software runs locally and we do not operate centralized services, there is no service level agreement, uptime guarantee, or technical support obligation.

12. Community Support

Support for the Software is provided on a voluntary, community basis through:

  • GitHub issues and discussions
  • Community forums and channels
  • Documentation and guides

There is no guarantee of response time or resolution.

13. Modifications to Terms

We may update these Terms from time to time. Changes will be posted on this page with a new "Last updated" date. Continued use of the Software after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflicts of law principles.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with the applicable open source license, constitute the entire agreement between you and Voquill regarding the Software.
